Terms and conditions of the online store

 

1. Company, contract

1.1. The online store located at www.vidanasart.com is operated by Vidana Blonska, registered at Warsaw,  (hereinafter: “Seller”), entered in the National Court Register of Business Entities, with REGON number : 522185998, NIP No.: 5213970802

1.2. You can contact the company that manages the online store in the following ways:

– using the feedback form in the online store.

 

2. General rules for using the Reserved online store

2.1. Only persons over 18 years of age can use the online store.

2.2. Persons registering and making purchases in the online store provide their personal data, which is processed by Seller under the conditions specified in the Privacy Policy.

 

3. Placing an order

3.1. Orders are accepted at vidanasart.com

3.2. Products in the online store have special marks. The website contains information about product characteristics, prices, materials from which they are made, and approximate availability of products in stationary stores.

3.3. When ordering a product, you choose it in the appropriate way for this product, in particular, specifying its size, color, quantity, and, if necessary, other necessary information.

 

4. How to buy in the online store – detailed instructions

4.1. After choosing the product of the right size, click on the “Add to cart” icon.

4.2. The product is added to the cart, which is visible in the upper right corner of the page. After selecting the “Proceed to checkout” option, if you are not authorized, you will be redirected to the authorization / account creation panel.

4.3. In the authorization / account creation panel, enter the necessary data for the transaction and delivery of goods.

4.4. After creating an account / authorization, you get access to additional options in the Buyer’s panel, such as order history, the status of the last order, saved delivery addresses, the ability to receive up-to-date information about goods from the store.

4.5. After choosing the delivery method and specifying all the necessary data (including, if necessary, account data), select the payment method.

4.6. In the payment selection section, you can choose one of the currently available payment methods.

4.7. Please note: Cash on delivery is possible only in Warsaw

4.8. Confirm the order by clicking on the “Checkout” button.

4.9. If you chose to pay online, you will be redirected to the order confirmation page; from which you can continue shopping or go to the summary of the order.

4.10. If Seller does not receive online payment, the order will be considered incorrectly placed, i.e. the contract will not be concluded and the order will not be processed.

4.11. At any stage of placing an order until the moment of its payment, you can cancel the order by stopping the registration process and leaving the order page. An order that has not been completed is considered canceled and will not be processed.

4.12. Immediately after placing the order, you will receive an order confirmation by e-mail to the address specified in the data for authorization. The e-mail will contain an individual order number, which can be used, for example, to check the status of the order.

4.13. Seller may contact you by e-mail or at the telephone number provided to clarify any uncertainties, confirm the order or for any other matter related to the processing of the order.

 

5. Prices

5.1. Prices on the website of the online store in US dollars 

5.2. The price of the product increases by the cost of delivery, which depends on the chosen method of delivery and payment.

5.3. The price indicated on the website at the time of placing the order is the final price, binding both for you and for Seller. After placing an order, the price of the product does not change, regardless of any price changes introduced by Seller or special offers and sales.

5.4. The Seller reserves the right to change the prices of products in the online store, to introduce new products for sale, to carry out and cancel special offers on the store website or to make changes to them.

 

6. Availability of ordered goods

6.1. All products offered in the online store are in stock.

6.2. In exceptional cases, for example, if several Buyers order the same product at the same time, it may not be available. In this case, you will be informed that the order cannot be processed.

6.3. The product card contains complete information about available sizes.

 

7. Inability to process the order

If an item is out of stock or the order cannot be processed for any other reason, you will be notified by email or phone. In particularly justified cases, the Seller may refuse to conclude a sales contract in order to protect its interests.

 

8. Delivery method and order fulfillment period

8.1. Goods are delivered worldwide.

8.2. If you have selected cash on delivery, your order will be processed immediately after placing your order. If you have chosen one of the online payment methods, the order will be accepted for processing when we receive payment for the product.

8.3. If the selected goods are in stock and you have chosen delivery to the specified address, the delivery time is from 1 to 21 working days after the successful placement of the order

8.4. Delivery time may be longer during sales or special promotions.

8.5. PLEASE NOTE: If you choose one of the currently available online payment methods, order processing begins upon receipt of 100% payment for the order, and from that date the countdown to delivery of the product to the Buyer begins.

8.6. Orders are delivered by a courier service.

8.7. Seller may from time to time and at no additional cost (except as set forth herein) offer you delivery options such as “buy today, collect tomorrow” or “buy today before 3:00 p.m., collect tomorrow”, which means that most products , ordered using this option, you will be able to receive it within 24 hours after placing the order, but this time is not guaranteed by Seller. This option is only available for orders with courier or post office delivery.

 

9. Methods of payment for the order

9.1. Cash on Delivery: This option is available only when ordering to the specified address in Warsaw 

 9.2. Bank transfer: Only online transfers are available using the payment method you have chosen. Once selected, you will be redirected securely to the platform of the selected payment operator. The payment transaction is carried out between you and the selected payment operator.

9.3. The Seller has an official bank account and it can be used for payment.

9.4. Payment card: you need to have a card that allows online payments (this can be checked with the issuing bank).

9.5. You can use PayPal payment method.

9.6. PLEASE NOTE: The online store will never send you a message that the payment account has changed. If you receive such an email, please do not make any payments or respond to it, please forward it unaltered Seller contact vidanaagency@gmail.com

 

10. Purchase and sale agreement

10.1. The information posted on the website www.vidanasart.com is not an offer to conclude a contract in accordance with the provisions of the Polish Civil Code, which means, in particular, that the Seller can refuse to conclude a contract in particularly justified cases, especially for the purpose of protecting its interests.

10.2. The contract is concluded in Ukrainian or English.

 

11. Execution of the contract – term of execution

Depending on the selected delivery option (or when received at the specified stationary store), Seller undertakes to send  the goods to you within 3 working days after the order has been properly placed. If an item is out of stock or the order cannot be processed for any other reason, Seller will contact the Buyer immediately and offer possible solutions. Business days are Monday through Friday, excluding public holidays.

 

12. Delivery cost

12.1. Worldwide delivery.

12.2. The total cost of delivery depends on the selected delivery and payment methods.

13. Renunciation of the contract

13.1. You have the right to terminate the contract of sale of goods without giving a reason (right to return the goods).

13.2. The contract can be terminated no later than 30 days after the date of receipt of the goods by you or by a third party other than the carrier and specified by you.

13.3. To exercise the right of termination, you must submit an unequivocal notice of termination to Seller in one of the following ways:

– by e-mail to the address: vidanaagency@gmail.com

– write us in direct in our official Instagram account @vidana_design

– fill in and send the online form, which is available in the Buyer’s panel for each order; if you use this form, you will soon receive confirmation that Seller has received the notice of termination.

WARNING! All methods of submitting a message are acceptable and all are equally effective.

13.4. In order to comply with the term of withdrawal from the contract, it is sufficient for you to send a notice of the exercise of the right of withdrawal before the end of the 30-day period specified in clause 13.2. above.

13.5. In the event of cancellation of the sales contract, Seller will refund all payments received from you, including the costs of delivery of the goods (excluding additional costs associated with choosing a delivery method other than the usual cheapest delivery method offered by Seller) without delay and in any case no later than 14 days from the date of receipt by Seller of the Buyer’s notification of the decision to exercise the right to withdraw from the contract, taking into account the provisions of clause 13.7. lower.

13.6. The refund will be made using the payment method you used during the original transaction, unless you have expressly agreed to another method – for example, in the case of a return to a brick-and-mortar store, the seller may offer a cash refund, which you may, but do not have to accept . In any event, you will not incur any costs in connection with obtaining a refund by any method other than that used to pay for the goods.

13.7. Seller may hold refunds until they receive and inspect the returned product.

13.8. The goods should be sent to the following address: Vidana Blonska, Dworkowa 2, Warsaw, 00-784, Poland, without delay and in any case no later than 14 days from the date of notification to Seller of your decision to exercise the right to cancel the contract purchase and sale. The deadline will be met if you send the product before the end of the 14-day period.

13.9. The product can be returned at your expense or through a courier designated by Seller at Seller’s expense. To take advantage of the return at Seller’s expense, fill in the contract cancellation form available for each order in the Buyer’s panel and specify the address where the courier should pick up the goods. In this case, you must make sure that the courier can pick up the goods from the place you specified on the specified date. If the courier is unable to pick up the goods, for example due to your absence at the specified address on the specified day, you lose the opportunity to return the goods by the courier at the expense of the Seller.

13.10. You can also return the product at our workplace in Warsaw 

13.11. You are responsible for reducing the value of the goods if they are used in a way that is not necessary to determine their nature, features and functioning.

 

14. Complaints

14.1. The subject of sale is new goods, without defects. In case of detection of product defects, the Seller is responsible for the defects.

14.2. All goods purchased in VIDANA  online store may be the subject of a complaint in accordance with the provisions of the Polish Civil Code regarding the statutory guarantee of sale, if the defect of the goods (including its non-compliance with the contract) is discovered within two years after its receipt by the Buyer.

14.3. Complaints can be submitted to our workplace in Warsaw or online.

14.4. In the case of submitting a complaint by mail, it is necessary to indicate the reason for the complaint and the information necessary to identify the order.

14.5. Seller allows buyers who file a claim to return defective goods by courier at Seller’s expense. To do this, you need to fill out the electronic complaint form and specify the address data at which the courier should pick up the parcel with the goods specified in the complaint. This right is exercised according to the rules set forth in clause 13.9 of this document.

14.6. The Seller considers the complaint within 14 days and informs the Buyer about the result of the review by e-mail or text message.

14.7. If the mailed claim is found to be valid, you will receive a refund for the product.

14.8. If a complaint submitted to a Seller is found to be valid, you will be able to receive the amount you are entitled to.

14.9. If a complaint is found to be unfounded, you will be informed of the reasons in a message sent to the email address specified in the order, and the product will be sent back to the address from which you sent the complaint.

15. Cancellation of order

You can cancel an order yourself within 15 minutes after placing it in the “My orders” tab of the Buyer’s panel by clicking the “Cancel order” button next to the order

 

16. Invoicing

16.1. If you request an invoice, you must provide the necessary details; the tax payer’s identification number, which is necessary for drawing up an invoice, must be specified no later than at the time of placing the order.

16.2. Seller is not responsible if you provide incorrect or incomplete invoice data.

17. Processing of personal data

In order to maintain the User account, conclude and execute sales contracts and fulfill the seller’s obligations arising from the conclusion of a distance sales contract, the Seller processes your personal data, which you provide voluntarily. All information regarding the processing of personal data is presented in the Privacy Policy section.
